Where a Rider is involved in an accident, injury, theft, robbery, loss of goods, serious product damage, road incident, or other material event connected with a delivery, the Rider should first take reasonable steps necessary for personal and public safety and obtain emergency assistance where appropriate..
The Rider shall report the incident to PalenquePH as soon as reasonably practicable and provide reasonably available information necessary for investigation, insurance, customer support, or regulatory purposes.
Nothing in these Rules requires a Rider to remain at or continue a delivery in circumstances presenting an immediate threat to personal safety.
6. Responsibility for Loss, Damage and Traffic Violations
A Rider may be responsible for loss or damage to an order where, after reasonable review of the circumstances and available evidence, the loss or damage is established to have resulted from the Rider’s fraud, intentional misconduct, unauthorized conduct, or negligent handling while the order was in the Rider’s custody.
A Rider is generally responsible for traffic fines or penalties legally imposed on the Rider as a result of the Rider’s own violation of traffic or vehicle laws, subject to applicable law and the circumstances of the incident.
Responsibility for an accident, product loss, damage, customer claim, or other incident shall not be determined solely by the fact that the Rider possessed the order or was involved in the delivery. PalenquePH shall consider reasonably available evidence and the respective acts or omissions of the Rider, Vendor, Customer, PalenquePH, and relevant third parties where applicable.
Nothing in these Rules excludes or transfers liability that applicable law places on PalenquePH or another person.
7. Deductions, Offsets and Rider Earnings
PalenquePH shall not automatically deduct the value of damaged or lost goods from Rider earnings merely because a complaint or incident has been reported.
Where a Rider is determined, following reasonable review, to be responsible for a loss or other amount under the Rider Agreement, PalenquePH may apply an offset, deduction, or recovery only to the extent authorized by the Rider Agreement and permitted by applicable law.
Where reasonably practicable, the Rider shall be informed of the material basis for a deduction, offset, or recovery and shall have an opportunity to provide relevant information concerning the incident.
Nothing in this Section authorizes a deduction prohibited by applicable law.

PalenquePH may investigate reported accidents, unsafe conduct, customer complaints, Vendor complaints, suspected fraud, order tampering, repeated delivery failures, or other material violations of these Rules or the Rider Agreement.
The Rider may be requested to provide relevant information, photographs, delivery records, incident reports, or other reasonably available evidence.
PalenquePH may temporarily restrict new delivery assignments while investigating a serious safety, fraud, security, or regulatory concern where reasonably necessary to protect Customers, Vendors, riders, PalenquePH, or the public.

- Temporary account suspension;
- Removal from a particular delivery or service area where reasonably justified;
