Customer Ordering Disclaimer – Standardized Pack Sizes & Fresh Product Variations

    Palenque offers fresh produce, meat, poultry, seafood, groceries, and other products     through participating Vendors. Some fresh products naturally vary in size, shape,     color, appearance, moisture content, trimming, and actual weight.  

 

    This disclaimer explains how standardized pack sizes, product variations, quantities,     and order discrepancies are handled on the Palenque marketplace.  

 

1. Standardized Pack Sizes and Units

 

    Products are offered according to the size, quantity, unit, pack, standardized weight     option, variant, or other specification shown in the applicable product listing.  

 

    For products commonly sold by weight, PalenquePH uses standardized weight or pack-size     options rather than a post-order variable-weight price adjustment system.  

 

    Examples may include product options such as 250 g, 500 g, 1 kg, one tray, one bundle,     one piece, one pack, or another clearly stated unit or variant, depending on the product.  

 

2. Price Shown at Checkout

 

    The Customer pays the price shown for the selected product, size, pack, quantity, or     variant at the time the order is confirmed, subject to applicable taxes, delivery fees,     service fees, discounts, promotions, and other charges disclosed during checkout.  

 

    PalenquePH does not increase or reduce the product price after the order merely because     the actual weight of a fresh product differs slightly from the nominal or standardized     pack weight shown in the listing.  

 

3. Natural Variations in Fresh Products

 

    Fresh agricultural and food products may naturally vary from one item or batch to another.     Depending on the product, variations may include:  

 

   
• Size, shape, and color
   
• Minor differences in actual weight
   
• Natural surface marks or cosmetic differences
   
• Ripeness, moisture, trimming, or cut characteristics
   
• Other ordinary natural variations consistent with the product type
 

 

    Normal natural variation does not by itself mean that a product is defective, provided     that the product remains safe, reasonably fresh, of acceptable quality, and substantially     consistent with the confirmed listing and order.  

 

4. Vendor Fulfillment Obligations

 

    Vendors must supply products that substantially correspond to the confirmed size,     quantity, unit, pack, standardized weight option, variant, and other material specifications     shown in the Customer’s order.  

 

    Vendors must not intentionally underfill a pack, provide a materially smaller quantity,     substitute a materially different size or product, or otherwise materially deviate from     the confirmed order without authorization through the applicable Palenque process.  

 

5. Material Shortages and Incorrect Quantities

 

    A minor natural variation in a fresh product is different from a material shortage or     fulfillment error.  

 

    If the Customer receives a materially short quantity, incorrect pack size, wrong product,     wrong variant, missing item, or another material discrepancy from the confirmed order,     the Customer may report the issue to PalenquePH for review.  

 

    Where a material discrepancy is established, an appropriate refund, replacement,     correction, or other remedy may be provided in accordance with the PalenquePH Refund,     Replacement & Cancellation Policy and applicable law.  

 

6. Product Substitutions

 

    A Vendor must not make a materially different substitution without Customer authorization     through the applicable Palenque order or support process.  

 

    Where a requested item is unavailable and the Platform supports substitutions, the Customer     may be offered an alternative product or variant and may accept or reject the proposed     material substitution.  

 

7. Product Quality

 

    Standardized pack sizing does not reduce a Vendor’s responsibility to provide safe,     properly handled, and reasonably fresh products in accordance with the PalenquePH Product     Quality & Packaging Standards and applicable law.  

 

    Products that are spoiled, contaminated, unsafe, materially damaged, materially misdescribed,     or otherwise subject to a valid complaint may qualify for a remedy under the applicable     PalenquePH policies and Philippine law.  

 

8. Reporting an Order Discrepancy

 

    Customers should report a suspected shortage, incorrect quantity, wrong pack, incorrect     product, or quality concern through the Palenque Platform or designated support channel     as soon as reasonably practicable after discovering the issue.  

 

    PalenquePH may reasonably request photographs, order information, packaging information,     or other evidence necessary to investigate the claim.  

 

    For fresh and perishable products, prompt reporting is particularly helpful because     product condition can change rapidly after delivery. Any operational reporting target     published by PalenquePH is intended to support investigation and evidence preservation     and does not automatically waive rights or remedies that cannot lawfully be waived.  

 

9. Refunds, Replacements and Corrections

 

    Refunds, replacements, corrections, cancellations, and other Customer remedies are governed     by the PalenquePH Refund, Replacement & Cancellation Policy, the PalenquePH Terms &     Conditions, and applicable law.  

 

    No separate post-delivery payment should be requested from a Customer merely because the     actual weight of a fresh product is slightly higher than the standardized weight option     selected in the confirmed order.  

 

    Likewise, PalenquePH does not use an automatic post-order refund merely because actual fresh     product weight is slightly below the nominal pack weight, unless the difference amounts to     a material shortage or other fulfillment discrepancy under the applicable policies.  

 

10. Relationship With Other Palenque Policies

 

    This disclaimer should be read together with the PalenquePH Terms & Conditions, Vendor     Agreement, Product Quality & Packaging Standards, and Refund, Replacement &     Cancellation Policy.  

 

    If there is a conflict between this disclaimer and a mandatory requirement of Philippine law,     the mandatory legal requirement will prevail.
