PalenquePH Rider Agreement

By registering as a rider on Palenque, you agree to the terms and conditions below. Please read carefully. Acceptance of this agreement is required to activate your account. This Rider Agreement governs all riders operating on the Palenque Delivery Driver App.

1. Nature of Relationship

Rider is an independent contractor, not an employee. This Agreement does NOT create;
  • Employment.
  • Agency.
  • Partnership.
  • Joint Venture.

Rider controls their own time, vehicle, expenses, and work availability..

2. Digital Acceptance

Rider acknowledges and agrees that:
  • Digital acceptance constitutes full legal consent.
  • All updates to this Agreement will be binding upon continued app use.
  • Rider's IP address, device ID, and timestamp of acceptance may be logged.
  • No physical signature is required.

3. Requirements

Rider must provide:
  • Valid Government ID.
  • Active mobile number.
  • Valid motorcycle OR/CR (if applicable).
  • Driver’s license.
  • Selfie verification.
  • Background check consent.

Rider must update documents upon expiration..

4. Rider Responsibilities

Rider agrees to;
  • Pick up and deliver orders promptly.
  • Use insulated bags where applicable.
  • Maintain hygiene and safe handling.
  • Follow traffic laws.
  • Coordinate courteously with customers and vendors.
  • Use only the app-designated route unless impractical.
  • Keep mobile device charged and connected.

5. Delivery Process

Rider must:
  • Accept or decline orders promptly.
  • Verify pickup items.
  • Check packaging integrity.
  • Complete deliveries using in-app navigation.
  • Mark orders “Delivered” only upon actual handover.

Fraudulent deliveries result in immediate suspension.

6. Payment Terms

Riders are paid based on:
  • Per-order fees.
  • Distance-based fees.
  • Incentives and bonuses (applicable only when announced).
  • Payouts occur weekly unless otherwise stated.
Riders acknowledge they are responsible for:
  • Gasoline.
  • Vehicle maintenance.
  • Insurance (optional but recommended).
  • Phone data expenses.

7. Liability

Rider is liable for:
  • Mishandling of goods.
  • Intentional or negligent damage.
  • Failure to complete a delivery.
  • Fraudulent activities.
Palenque is not liable for:
  • Vehicle accidents.
  • Traffic violations.
  • Rider injuries (Rider is not an employee).
  • Losses caused by Rider misconduct.

8. Safety and Conduct

Rider must NOT:
  • Tamper with products.
  • Open sealed items.
  • Consume customer orders.
  • Use illegal substances.
  • Engage in harassment or unprofessional behavior.

9. Data Privacy

Rider acknowledges:
  • PalenquePH collects personal and location data for delivery operations.
  • Data may be shared with vendors, customers, and authorities as required.
  • Rider must protect customer data and not store or use it outside the app.

Violation results in account removal and possible legal action.

10. Device And App Usage

Rider agrees to:
  • Use the app only for legitimate deliveries.
  • Not manipulate GPS or order flow.
  • Not use rooted/jailbroken devices to bypass security.
  • Accept system updates required for operations.

11. Suspension and Termination

PalenquePH may suspend or terminate Rider access for:
  • Fraud.
  • Repeated cancellations.
  • Abusive behavior.
  • Safety violations.
  • Poor performance.
  • Violations of this Agreement.

Rider may terminate at any time by uninstalling the app and notifying support.

12. Governing Law and Dispute Resolution

Philippine law applies

Venue: Taguig City

Disputes will first undergo mediation before court action

13. Digital Signature Effect

By registering, Rider agrees that this Agreement has the same legal effect as a signed physical contract.
